Consumers in debt can hope: in the future, they will have a faster chance of a debt-free new start after going bankrupt. The EU wants to shorten the duration of private insolvencies to three years.

This could now change. European parliament, council and commission recently agreed to shorten the time limit to three years. The corresponding guideline is expected to be available in summer. "The directive stipulates that the debtor must be able to achieve debt relief within three years. The current german regulation will not be able to remain as it is."

The federal ministry of justice said in response to a question that it would get to work on implementing the directive as soon as possible after it had been finally adopted.

However, only consumers who fall into the debt trap in the future were allowed to benefit from the new regulations. "Applying the future system to old cases would be very unusual," said henning, who is a member of the working group on insolvency law and reorganization in the german lawyers' association (DAV). The experts had already demanded in the past that the remaining debt be forgiven in principle after three years without any quota - also in order to relieve the justice system.

According to calculations by crif burgel, since the reform of insolvency law came into force in summer 2014, a total of 7.4 percent of those affected, including the formerly self-employed, have been granted residual debt discharge after three years. Crif burgel evaluated data from the local courts.

On average, the people affected are reported to be in debt to the tune of around 30,000 euros. But there are major differences between the age groups. Under-25s owe an average of just under 11,000 euros in debt. They succeed disproportionately often in getting the remaining debts forgiven after only three years.

With older people, the mountain of liabilities is usually much larger, for example because of the purchase of a property. Over 61-year-olds who filed for personal bankruptcy had accumulated an average loss of 45,000 euros.

During the period of insolvency, those affected must surrender the portion of their income that exceeds the minimum subsistence level. Possessions, if they are not vital, are pawned.

According to data from the credit reference agency creditreform, 68,600 private individuals (excluding the formerly self-employed) slipped into bankruptcy last year. That was 4.7 percent fewer than a year earlier. According to creditreform, the main reasons for this are falling unemployment figures and rising gross wages.
